Everything You Need to Know About Slip and Fall Accidents

Slip and fall accidents are some of the most common personal injury claims that lawyers receive. More often than not, a young victim’s physical health is not immensely jeopardized, however, as people get older, these accidents become much more common and dangerous.

Everything You Need to Know About Slip and Fall Accidents

In these instances, the victim’s health is a top priority, however, they should also be entitled to fight for their compensation and dispute their losses.

Accidents Aren’t Limited to Indoor Areas

Most people assume that premises liability law only applies to indoor areas.

However, if you were to suffer an accident in the car park of a grocery store, you would also be eligible to sue for personal injury.

Slip and fall accidents can be caused by wet floors, parking lot potholes, or even defective sidewalks.

You Only Have a Limited Time to File a Lawsuit

When you experience an accident of this kind, it’s important that you act within the legal timeframe.

If you don’t file before the required deadline, you will lose your right to file a lawsuit. Each state will have its own statute of limitations, so make sure to get informed at your local law firm.

However, don’t forget that you only have a limited time to file the claim, not to actually settle the case.

Evidence is Key to a Strong Case

Evidence is the most important factor that determines whether or not you have a strong chance of winning your case. If you compile a checklist after an accident, you will avoid forgetting any important evidence.

Most importantly, you need some sort of proof that shows there was a hazardous condition that caused your accident.

Take your own pictures and videos as soon as you can, if not ask to check security cameras at the establishment.

Other key pieces of evidence include detailed medical reports and hospital records.

Follow Your Doctor’s Recommendations

Following your doctor’s recommendations is good for both your personal health and your case.

If you miss an appointment or refuse to follow the doctor’s orders, this may be used against you in a court of law.

The opposition could argue that you are exaggerating your injury if you don’t comply with your doctor’s recommendations.

Keep Off Social Media

It may be tempting to share the details of your accident with your friends and family, but if you find yourself in the middle of a legal dispute, it’s best to stay offline for the time being.

This includes day-to-day posting about your life. If a legal representative saw your post about having fun and partying when you said you were injured and impaired, this could severely damage your chances of settling the claim.

In the worst-case scenarios, slip and fall accidents can cause serious injuries such as brain trauma or hip fractures.

This experience can be highly taxing on an individual and their family as well. It is only fair that they focus their energy on recovering their health, not on paying for their medical expenses.
